Introduction
Welcome to Stayzee, a trusted Guest-led platform that specializes in connecting Guests with safe, reliable, and affordable housing solutions. These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (the “Guest”) and Stayzee. By registering on the platform, creating an account, or availing accommodation services, you fully and unconditionally agree to abide by these Terms in their entirety.
Stayzee has designed these Terms not merely as a set of guidelines, but as a comprehensive framework of rights and responsibilities that will govern your stay arrangements, Hospitality Contribution, and community behavior. It is important to note that these Terms are binding from the moment you accept accommodation through Stayzee, and they remain enforceable for the entire period of your stay arrangements and any renewal thereafter.
1. Eligibility and Guest Accounts
- 1.1 To be eligible to use Stayzee Services, you must create a verified account with accurate, truthful, and complete information. This includes government identification, academic credentials, and contact details.
- 1.2 Guests must be at least 18 years old to register independently. Guests below 18 must have their account registered and managed by a legal guardian, who shall assume all liabilities and obligations under these Terms.
- 1.3 Each Stayzee account is strictly personal and non-transferable. Guests are prohibited from creating duplicate accounts, impersonating others, or sharing their login credentials.
- 1.4 Guests are solely responsible for maintaining the confidentiality of their account details. Any misuse, negligence, or disclosure of credentials will be considered a violation of these Terms.
2. Accommodation and Minimum Stay Requirement
- 2.1 By entering into this Agreement, the Guest agrees to a preferred minimum stay commitment of six (6) months, under mutual understanding with the Host from the date of initial check-in.
- 2.2 This six-month preferred stay is designed to ensure continuity and stability for Hosts and Guests. Early departure is strongly discouraged and may lead to adjustments in Hospitality Contributions or discontinuation of services, as mutually agreed with the Host and Stayzee.
- 2.3 In the event of extraordinary circumstances where a Guest seeks to vacate before the completion of six months, a written request must be submitted to Stayzee at least thirty (30) days in advance. Approval of such a request shall remain at the sole discretion of Stayzee.
- 2.4 In case of early departure, Guests may, by mutual consent, choose to continue supporting Hospitality Contributions for the remaining stay period until a replacement Guest is arranged. Stayzee will make reasonable efforts to assist in arranging such replacement.
- 2.5 Refunds, deposits, and advance contributions will follow the Host’s policies. Stayzee will help facilitate communication between Guest and Host to arrive at a fair, mutually agreed consensus.
- 2.6 Guests desiring to extend their stay beyond the minimum six months must apply for renewal in writing at least one month prior to expiry. Stayzee will facilitate renewal discussions with Hosts to ensure continuity.
3. Payment Terms and Financial Obligations
- 3.1 All Hospitality Contributions, deposits, and facilitation fees must be made exclusively via Stayzee’s secure online payment gateway. Payments made directly to Hosts or via unauthorized channels shall not be recognized.
- 3.2 At the time of onboarding, Stayzee shall deduct a one-time facilitation fee equal to one-fourth (¼) of the first month’s Hospitality Contribution. This amount is non-refundable and covers administrative, verification, and platform management services.
- 3.3 Hospitality Contribution is payable on or before the mutually agreed date between Host & Guest. Any delay in payment may result in late fees, penalties, or suspension of services.
- 3.4 If a Guest is unable to continue Hospitality Contributions, Stayzee will facilitate discussions between Guest and Host to reach a fair mutual settlement, which may include discontinuation of the arrangement.
- 3.5 Guests acknowledge that Hospitality Contributions are generally expected for the mutually preferred six-month stay period, even in case of early departure, unless otherwise agreed with the Host.
4. Guest Conduct and Responsibilities
- 4.1 Guests are expected to conduct themselves with dignity and respect during their arrangement. Acts of harassment, violence, illegal activity, or misconduct will be treated as violations of these Terms.
- 4.2 Guests must maintain cleanliness, safety, and respect for the Host’s property. Any damage caused must be promptly reported and fully compensated.
- 4.3 Guests are required to abide by all house rules and community guidelines issued by the Host or Stayzee.
- 4.4 The Guest acknowledges that accommodation through Stayzee is a privilege based on mutual consent and shared responsibility. Violations of conduct policies may lead to eviction without refund.
5. Stayzee’s Role and Limitations
- 5.1 Stayzee is a facilitator platform and not a broker, agent, or landlord.
- 5.2 Stayzee verifies Guest details, facilitates Hospitality Contributions securely, and provides limited dispute mediation.
- 5.3 Stayzee does not guarantee employment, admission to institutions, or personal success. Its role is limited to facilitating housing.
- 5.4 Stayzee shall not be held liable for losses or damages resulting from actions of Hosts, Guests, or third parties.
6. Conduct on the Platform
- 6.1 Guests shall not misuse the Stayzee platform by creating false profiles, bypassing verification, or attempting unauthorized access.
- 6.2 Any attempt at fraud, hacking, or impersonation will lead to immediate termination of services and possible legal action.
- 6.3 Stayzee reserves the right to monitor and investigate suspicious activities and to suspend accounts without prior notice.
7. Safety, Privacy, and Data Protection
- 7.1 Stayzee collects and processes personal data solely for verification and operational purposes.
- 7.2 Data may be shared with Hosts, authorities, or regulatory agencies as required under law.
- 7.3 Guests are responsible for their personal safety, safeguarding their belongings, and compliance with local safety rules.
8. Dispute Resolution and Governing Law
- 8.1 Stayzee will attempt to mediate disputes fairly between Guests and Hosts.
- 8.2 If disputes cannot be resolved, they shall be governed under Indian law and subject to the jurisdiction of courts in West Bengal.
9. Limitation of Liability
- 9.1 Stayzee provides Services on an “as is” and “as available” basis with no warranties, whether express or implied.
- 9.2 Stayzee shall not be liable for force majeure events or Host negligence. In cases of Guest misconduct, Stayzee will intervene through mediation and enforcement of community standards, but financial or legal responsibility for damages shall remain between Guest and Host.
- 9.3 Stayzee shall not be held liable for indirect, incidental, or consequential damages.
10. Termination of Services
- 10.1 Stayzee reserves the right to terminate accounts for unpaid Hospitality Contribution, misconduct, or violation of these Terms.
- 10.2 Guests may request termination of their account; however, continuity of Hospitality Contributions will be encouraged in line with the mutually preferred six-month stay commitment, unless otherwise agreed with the Host.
11. Communications
- 11.1 Guests consent to receiving notifications relating to Hospitality Contribution, stay arrangement, and services.
- 11.2 Promotional content may be opted out of, but mandatory service notifications cannot be disabled.
12. Miscellaneous Provisions
- 12.1 These Terms form the complete and binding agreement between Stayzee and the Guest.
- 12.2 Stayzee reserves the right to assign its rights under this Agreement. Guests may not assign or transfer obligations.
- 12.3 If any provision is deemed unenforceable, the remaining sections shall remain in full effect.
Conclusion
By registering with Stayzee and using its Services, the Guest confirms that they have read, understood, and accepted these Terms.
The Guest further acknowledges that:
- A six (6) month minimum stay is a mutually preferred commitment.
- Hospitality Contributions are expected to be honoured throughout this duration, based on mutual consent.
- Failure to comply may result in forfeiture of deposits or discontinuation of services, in line with Host policies and mutual consent.
Stayzee remains committed to ensuring safe, transparent Hospitality Contribution, and reliable Guest accommodation, while requiring Guests to uphold their responsibilities in return.
